Terms of Service

##1. Agreement to Terms

These Terms of Service govern your use of ShirtMap, including our website, web app, mobile app, map, listing tools, business owner features, customer submission tools, subscription features, checkout and order features, and related services. Purchases made directly on ShirtMap are also governed by our Purchase Terms and Refund Policy, and selling on ShirtMap is additionally governed by the seller terms presented during selling setup.

By using ShirtMap, you agree to these Terms. If you do not agree, do not use ShirtMap.

2. What ShirtMap Does

ShirtMap is a map-based discovery platform that helps users find T-shirts connected to real businesses, towns, regions, teams, events, and local places.

ShirtMap may display links to third-party websites, storefronts, social media profiles, payment links, or other places where users can learn more about or purchase shirts. Some businesses also sell their shirts directly through ShirtMap.

ShirtMap itself does not sell the listed shirts. Purchases happen either through the third-party businesses or platforms a listing links to, or, where a business has enabled selling, directly on ShirtMap from the selling business, which is the merchant of record for the sale.

3. User Roles

ShirtMap may support different user roles, including:

• Visitors or customers
• Buyers who purchase directly from businesses on ShirtMap
• Business owners
• Admins
• Future registered users or contributors

Access to certain features may require an account, approval, subscription, or admin permission.

4. Business Owner Submissions

Business owners may submit business information, shirt listings, images, descriptions, prices, buying methods, locations, and links.

By submitting content to ShirtMap, you represent that:

• You have the right to submit the content
• The information is accurate to the best of your knowledge
• The images, logos, descriptions, and links do not infringe anyone else's rights
• The listing relates to a real business, place, event, team, town, or region
• You will keep listing information reasonably current

ShirtMap may approve, reject, edit, remove, or request changes to submissions at any time.

5. Customer Submissions and Tips

Customers may submit shirt tips, business suggestions, photos, links, or other information.

Submitting a tip does not guarantee publication, approval, credit, rewards, badges, or business participation.

ShirtMap admins may review, edit, verify, reject, or use submissions to invite business owners to claim or approve listings.

6. Admin Approval

Public display of listings may require admin approval. ShirtMap may review:

• Business identity and category
• Location details
• Images and shirt descriptions
• Buying links and submitted tags
• Customer tips
• Potential misuse, spam, or policy violations

ShirtMap may remove or hide listings at any time, including for quality, safety, legal, business, or product reasons.

7. Subscription Features

Business owners may purchase subscriptions or premium features.

Premium features may include enhanced visibility, upgraded pins, featured placement, additional listing tools, or other paid features.

Subscription details, pricing, renewal terms, cancellation rules, and refund rules will be shown at checkout or in subscription materials. ShirtMap may change subscription features or pricing in the future. Changes will apply according to the terms presented at the time of purchase or renewal.

Unless stated otherwise at checkout, subscription changes and cancellations take effect at the end of the current billing period. Access to paid features continues until then, and no refunds are issued for the current period.

8. Payments

ShirtMap uses Stripe as its third-party payment processor for all payments: business owner subscriptions and premium features paid to ShirtMap, and purchases made directly from businesses on ShirtMap, which Stripe processes on behalf of the selling business.

By purchasing a ShirtMap subscription, paid feature, or item sold on ShirtMap, you agree to pay all applicable fees and authorize Stripe to process your payment method. ShirtMap does not store full credit card numbers or complete payment card details on its own servers.

Businesses that sell on ShirtMap must complete payment onboarding with Stripe to receive payouts. Their use of Stripe's services is subject to Stripe's own agreements.

Your use of Stripe's payment services may be subject to Stripe's own terms, conditions, and privacy policy. Subscription prices, renewal terms, cancellation options, and any refund terms will be shown at checkout or in the applicable subscription materials.

9. Third-Party Payment Processor

Stripe is an independent third-party service provider. ShirtMap is not responsible for Stripe's services, payment processing decisions, account approvals, declines, holds, disputes, chargebacks, fees, or other actions taken by Stripe.

If a payment fails, is declined, disputed, refunded, or otherwise interrupted, access to paid ShirtMap features may be delayed, paused, downgraded, or canceled.

10. Buying and Selling Directly on ShirtMap

Some businesses sell their shirts directly through ShirtMap. These purchases are governed by our Purchase Terms and Refund Policy, in addition to these Terms.

• When you buy on ShirtMap, you are buying from the listed business — not from ShirtMap. The selling business is the merchant of record and is responsible for producing and shipping your order, product quality, refunds, and returns.
• ShirtMap provides the marketplace platform: listings, the shopping cart, checkout and payment processing through Stripe, and order tools for the selling business.
• Selling on ShirtMap requires an approved business listing, an active Premium subscription, and completed payment onboarding with Stripe. Selling businesses are responsible for fulfillment, refunds, chargebacks and disputes, applicable taxes, and the accuracy of their listings.
• ShirtMap charges selling businesses a platform fee on each sale, and may suspend or disable selling for any business at any time, including for policy violations, disputes, legal risk, or nonpayment.

11. No Responsibility for Third-Party Sales

ShirtMap may link to third-party stores, websites, social media pages, payment links, or business-owned platforms. When a purchase happens off ShirtMap through such a link:

• ShirtMap is not the seller of listed shirts
• ShirtMap does not control pricing, inventory, shipping, taxes, returns, refunds, order fulfillment, or product quality
• ShirtMap is not responsible for disputes between customers and third-party businesses
• Customers should contact the selling business directly for purchase questions

For purchases made directly on ShirtMap, the selling business remains the merchant of record and is responsible for the order, as described in our Purchase Terms.

12. Listing Accuracy

We try to keep ShirtMap useful and accurate, but we do not guarantee that any listing, price, shirt availability, link, location, business status, or buying option is complete, current, or error-free. Businesses are responsible for keeping their listing information accurate.

13. Map and Location Information

Map pins and locations may be approximate. A location may represent a town, region, business area, storefront, event location, or other general place. ShirtMap does not guarantee exact location accuracy. Users should verify details with the business before visiting or purchasing.

The interactive map is powered by Mapbox, a third-party service. Depending on your region, the map may not load until you consent. The data Mapbox stores on your device is described in our Privacy Policy. ShirtMap also uses cookies and similar technologies as described in that policy.

14. Content License

By submitting content to ShirtMap, you grant ShirtMap a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, format, publish, and distribute the content for operating, promoting, and improving ShirtMap. This includes using submitted business names, shirt images, descriptions, links, tags, and related listing content in ShirtMap's website, app, map, social media, marketing, and promotional materials.

You retain ownership of your content, subject to the rights you grant ShirtMap.

15. Prohibited Content and Conduct

You may not use ShirtMap to submit, upload, link to, or promote content that:

• Is false, misleading, fraudulent, or deceptive
• Infringes intellectual property or privacy rights
• Contains unlawful, harmful, abusive, hateful, or harassing material
• Contains malware, phishing links, or unsafe content
• Promotes illegal goods or services
• Impersonates another person or business
• Attempts to manipulate rankings, approvals, badges, or subscription features
• Interferes with ShirtMap's security, systems, or operations

ShirtMap may remove content or suspend access for violations.

16. Intellectual Property

ShirtMap, including its name, logo, design, map experience, software, branding, and related materials, is owned by ShirtMap or its licensors. You may not copy, modify, distribute, reverse engineer, or misuse ShirtMap's intellectual property except as allowed by these Terms or with written permission.

17. Account Security

If ShirtMap provides accounts, you are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify ShirtMap through our contact form if you suspect unauthorized access.

18. Service Changes

ShirtMap is evolving. We may add, change, suspend, or discontinue features at any time, including map features, subscription tiers, listing rules, approval processes, filters, or business tools.

19. Disclaimer of Warranties

ShirtMap is provided "as is" and "as available." We do not guarantee that ShirtMap will be uninterrupted, secure, error-free, or always accurate. To the fullest extent allowed by law, ShirtMap disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

20. Limitation of Liability

To the fullest extent allowed by law, ShirtMap will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or third-party disputes.

ShirtMap's total liability for any claim will not exceed the amount you paid to ShirtMap in the three months before the claim, or $100 if you paid nothing.

21. Indemnification

You agree to defend, indemnify, and hold harmless ShirtMap from claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of ShirtMap
• Your submitted content
• Your products, shirts, listings, or links
• Your violation of these Terms
• Your violation of any law or third-party rights

22. Termination

We may suspend or terminate access to ShirtMap or remove listings at any time if we believe there has been a violation of these Terms, legal risk, misuse, nonpayment, or harm to the platform or users.

23. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any disputes will be handled in the courts located in Massachusetts, unless applicable law requires otherwise.

24. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date. Continued use of ShirtMap after changes means you accept the updated Terms.
